Firm History

The law firm of Fallace & Larkin was formally organized in 2001 and was established by its founding members, Jim Fallace and David Larkin. The attorneys in the Firm previously provided legal services for its clients in Fallace & Associates, P.A. which was formed by Jim Fallace in 1992. Prior to moving to Brevard County, Florida, Jim practiced law in northwest Indiana and in 1981 Jim became a partner in a Chicago law firm. In 1986, Jim relocated to Florida and served as outside general litigation counsel to a national insurance company and multi-division insurance group and was a founding partner in Frese, Fallace, Nash & Torpy, located in Melbourne, Florida. In 1995, David moved from Leesburg, Florida and joined Fallace & Associates after working at one of the largest law firms in Lake and Sumpter Counties, Florida. Jesse Kabaservice joined the Firm in 2002 after working with the Office of the Public Defender in Brevard County as an assistant public defender, handling all aspects of felony cases, including depositions, pretrial motions and jury trials. In 2008 Drew Williams joined the Firm after graduating from Stetson University College of Law. The Firm is located near the central business district of downtown Melbourne in a historic building of Mediterranean architecture originally constructed in 1928 and renovated to its existing structure in 1999.

The Firm is structured to provide individualized client attention in a boutique setting in all aspects of business and commercial entity formation, contracts, transactions, and litigation. These services include entity selection and formation to meet the client’s goals and needs, preparation of entity governance documents including shareholder, partnership and operating agreements, drafting internal client employment and contractor agreements and contracts with third parties, preparing asset, stock and membership sale and acquisition agreements; and, when necessary, representing clients in complex commercial litigation in both state and federal court actions and arbitration proceedings. The Firm provides ongoing legal services for its client’s and their business transactions with third parties in a broad range of areas of the law such as construction, health care, residential and commercial real estate, title insurance, employment and business law. The Firm’s attorneys routinely provide representation for the firm’s clients and practice in both Federal and state trial and appellate courts.
